Welcome to Fish Cast. These Terms of Service ("Terms") govern your use of the Fish Cast mobile application ("App") operated by Fish Cast ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Fish Cast, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms. If you do not agree, you must not use the App.
2. Account Registration
To access certain features, you may create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
3. Description of Services
Fish Cast provides the following services:
- Fish Activity Forecasts — Hourly activity scores based on solunar data and barometric pressure trends
- Tide Data — 24-hour tide charts, high/low tide times, current strength, and trend analysis
- Wave Conditions — Wave height, period, direction, swell data, ocean currents, and sea temperature
- Weather Forecasts — Temperature, humidity, pressure trends, wind data, and precipitation forecasts
- Solunar Clock — Major and minor solunar periods, moon phases, and sunrise/sunset times
- Interactive Map — Location-based fishing spot discovery and saving
4. Disclaimer of Accuracy
Fish Cast provides forecasts and data for informational purposes only. While we strive for accuracy, we do not guarantee that any forecast, prediction, or data point is entirely accurate, complete, or reliable. Weather, tide, wave, and fish activity data are based on third-party sources and computational models that may contain errors.
You should never rely solely on Fish Cast data for safety decisions. Always check official marine forecasts and weather warnings before engaging in any water-based activity.
5. User Content
You may save fishing locations and other content within the App ("User Content"). You retain ownership of your User Content. By saving content, you grant us a limited license to store and display it within the App for your personal use.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to reverse engineer, decompile, or disassemble any part of the App
- Interfere with or disrupt the App's servers or networks
- Use automated tools to scrape or extract data from the App
- Create multiple accounts to circumvent restrictions or bans
7. Intellectual Property
All content, features, and functionality of Fish Cast — including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software — are the exclusive property of Fish Cast and are protected by international copyright, trademark, and other intellectual property laws.
8. Third-Party Services
Fish Cast integrates with third-party services including Google Maps, Google Sign-In, Apple Sign-In, Open-Meteo API, and Supabase. Your use of these services is subject to their respective terms and privacy policies.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Fish Cast shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages for loss of profits, data, or other intangible losses.
In no event shall our total liability exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
10. Account Deletion
You have the right to delete your account at any time. To delete your account:
- Open the Fish Cast app and navigate to Profile > Settings > Delete Account
- Confirm your decision when prompted
Upon account deletion:
- Your profile information (name, email, profile picture) will be permanently deleted
- All saved fishing locations will be permanently removed
- Your preferences, settings, and app data will be erased
- Any data associated with your account on our servers will be permanently deleted within 30 days
- This action is irreversible — once your account is deleted, it cannot be recovered
If you are unable to access the App, you may also request account deletion by contacting us at support@fishcast.app with the email address associated with your account.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or via the email associated with your account. Your continued use of the App after such notification constitutes your acceptance of the updated Terms.
12. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
